Terms and Conditions for Ordering with Divine Indulgence LLC

To ensure a seamless and successful order process, please review the following terms and conditions:

  • **Orders will not be considered "booked" or placed on our calendar until the non-refundable retainer fee is received. ** Once the retainer or payment in full is received, the planning and preparation phase will begin.
  • Invoices not secured with a deposit or full required payment will cancel 72 hours after issuance. If not paid by the scheduled due date, orders will not be processed or considered complete until the retainer/design fee or full payment has been made. A $25.00 convenience fee will be incurred if the invoice cancels and the customer requests to have it resent.
  • When you request an invoice, a contract regarding your order will be attached. Please read the contract before paying the invoice, as paying the invoice means you agree to all terms and conditions stated in the contract.
  • Order balances must be paid in FULL by the due date on the invoice, or the date and retainer fee will be forfeited. Orders will not be completed, and retainer fees WILL NOT be refunded.
  • Orders may be rescheduled up to 14 days prior to the order due date. If canceled within 14 days of the order due date, securing a new date will be subject to the availability of openings in our schedule. Once invoice details have been secured, changing any details of the order may result in an additional 15% fee. Moving the date of your event will require that your order be paid in full before the date is moved, and the full amount of your order is non-refundable and non-transferable. If you must move the date again, a 25% non-refundable fee will be applied. Moving the date is subject to calendar availability. We are not obligated to accommodate a date of which we are already fully booked or unable to work on. You are still responsible for the total set in the original contract.
  • Divine Indulgence LLC reserves the right to interpret and design treats and cakes based on your theme. We will attempt to match the requested color to the best of our ability, but color matching is not guaranteed. The colors blue and purple or any shade of those colors cannot and will not be guaranteed, as these colors are very unstable and tend to fade or bleed into surrounding colors of frosting. Divine Indulgence LLC will not copy another artist's work and reserves the right to make any changes to the design to make it our own.
  • Under no circumstances will DISCO DUST, LUSTRE DUST, OR GLITTER be used on food items to be consumed. These items are NON-TOXIC but are not meant for human consumption. They may only be used on decorations that are to be removed prior to consumption. Sanding sugar, edible pearls, and ONLY hybrid or sparkle dust that is labeled EDIBLE can be used. This is NON-NEGOTIABLE.
  • Once a product leaves Divine Indulgence's possession, we are no longer responsible for damages, care, or handling that may incur. Driving and handling instructions have been given to you in writing. It is recommended that all custom cakes 2 tiers and greater be delivered to ensure a safe arrival to the event venue. If you have declined delivery, please be aware that any damage sustained is not the responsibility of Divine Indulgence LLC. Repair of damages is subject to availability and will incur a $50 service fee. We will be unable to travel to venues greater than 20 miles to repair damages.
  • ALL SALES ARE FINAL.
  • Divine Indulgence LLC will photograph orders and reserves the right to use any and all photographs for display or promotion without permission or compensation to you. Photos will not be posted until after the order has been picked up or delivered. If the items ordered are a surprise, please make us aware, and we will delay posting until after the event time. If you do not wish to be tagged in the items on social media, please notify us at the time of pick-up or delivery.
  • We do not provide sketches or previews after your order is in progress, as it is time-consuming and delays the work process. We strive to bring you the best possible product(s) as discussed in your consultation. We will not copy another artist's work but will use it as inspiration to give you your own unique item(s).
  • In the case of an emergency or error in your cake or dessert delivery on our part, please contact us immediately so that we can fix the issue right away. If you are unhappy with your cake for any reason, please call us the day of your event and explain the situation. In the rare case that you are unhappy with your cake or desserts and would like a refund, you must call the day of your event so that your cake or desserts can be returned. Without proof that you are indeed unhappy with the product and will not be using it for your event, we will be unable to refund you a portion of your payment. This is necessary to hinder the very rare case of the "If we complain, we'll get a free cake" issue we occasionally come across. We are dedicated to satisfying our client's cake needs. Your cake needs to be untouched and uneaten.
  • Deliveries are contingent upon the ability of Divine Indulgence LLC to complete the order and are subject to labor disputes or strikes, accidents, Acts of God (natural disasters), inclement weather, illness, death, and/or other causes beyond our control. If Divine Indulgence LLC has completed your cake, treats, or desserts, but they cannot be delivered due to any of these circumstances, Divine Indulgence LLC will refund the client 60% of the total cost.
  • In the event of the death of the customer/client, a refunded minus the 50% retainer fee within 7-10 business days. In case of death of the owner of Divine Indulgence LLC, all money will be refunded within 60 days of their death by the authorized representative.
